1. Acceptance of terms
By creating an account or using Fosteo, you agree to these Terms of Service and to Stripe's Connected Account Agreement (for creators). If you do not agree, do not use the service.
2. The service
Fosteo lets creators accept one-time tips and monthly support through a shareable page. Fosteo is a wrapper around Stripe's payment infrastructure: we provide the interface and Stripe processes and settles all payments.
Fosteo is not a storefront for physical goods. Creators may, however, offer digital perks to supporters — such as community access, invites, exclusive updates, or a thank-you note — as part of the support they provide. Payments are support for a creator's work, not a purchase of goods.
3. Eligibility
You must be at least 18 years old (or the legal age of majority in your jurisdiction) and legally able to enter into this agreement. You must accurately complete identity verification through Stripe before receiving payouts.
4. Fees
Fosteo charges a platform fee per tip as described on our pricing page. Fees are deducted from each payment before funds are settled to you. Fee rates may change; we will provide notice of material changes.
5. Stripe relationship
Payouts are governed by Stripe's Connected Account Agreement and Stripe's own terms. Stripe collects identity and bank details, controls payout availability and schedules, and performs compliance reviews. Fosteo does not store your bank account details and is not a bank, payment processor, or money transmitter.
6. Refunds, disputes, and chargebacks
Payments are support for a creator's work and are generally non-refundable. Fosteo does not offer refunds; a supporter's payment settles directly to the creator. If a supporter disputes a payment, the dispute is handled by Stripe.
When a chargeback occurs, Fosteo covers the resulting liability on behalf of the creator. However, if a creator accumulates multiple chargebacks or refunds (a reasonable threshold determined by Fosteo, at or around two to three such events), Fosteo may deduct the full value of those chargebacks from the creator's balance or future payouts. Excessive or repeated chargebacks or refunds may result in the creator's account being restricted or terminated from the platform.
7. Creator responsibilities and acceptable use
You are solely responsible for your content, your tax obligations, and your compliance with all applicable laws. You may not use Fosteo for fraud, illegal activity, money laundering, or prohibited content.
Adult and sexually explicit content is strictly prohibited. Fosteo does not support creators whose content is designed for sexual gratification, including pornography, explicit imagery, or any mature content intended for that purpose.
You must comply with our Acceptable Use Policy. Fosteo may restrict, suspend, or terminate accounts that violate these terms or present fraud or compliance risk.
8. Monthly support
Supporters can cancel monthly support at any time through the Stripe-hosted management page. Recurring payments may fail if a payment method is declined or becomes invalid, and Fosteo is not liable for failed or interrupted recurring support.
9. Taxes
You are responsible for determining and remitting any taxes that apply to income you receive. Fosteo does not determine, collect, or remit taxes on your behalf.
10. Account termination
You may stop using Fosteo at any time. We may suspend or terminate your account for excessive disputes, fraud, abuse, or violation of these terms, with or without notice where required for compliance or security.
11. Disclaimer of warranties
Fosteo is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted access or that the service will be error-free.
12. Limitation of liability
To the maximum extent permitted by law, Fosteo is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the service.
13. Changes to these terms
We may update these terms as Fosteo changes. Continued use after an update constitutes acceptance of the revised terms.
14. Governing law
These terms are governed by the laws of the jurisdiction in which Fosteo operates, without regard to conflict-of-law principles.
